I love the british court system

So I wrote to kent police to request her name and address from their dataprotection registrar and lo and behold it arrived. I then set up an account with www.moneyclaim.gov.uk a brilliant online service from her majesty's justice system.

This is basically a low cost way of bringing a civil claim against someone. It took a few steps - to start the case - and then go through various court driven proecdures where they served notice on the woman. It cost me time and money (well over £100 in all) but the woman refused to acknoweledge any documents the court sent her.

In the end, they sent the bailliffs around (costing me even more money) and after several attempts she contacted me by post! Saying she did't live there. I'll bet. Not just a cheat but a liar as well.

I convinced her by e-mail to contact the court and start to engage with the process. Which she did and after some negotiation through the court she agreed to pay £30 per month from August 2008 until the debt plus costs plus interest had been repaid.

So every month she writes me a cheque, sometimes sending it by registered post(what, she doesnt trust me!!!) sometimes not. Which in a way is nice as she is reminded every month over a 12 month period about the fact she stole from me.

Case closed.

Kent Police find EBAY offender

They found him. Or rather they found her, a middle aged woman in Northolt, Middlesex. Apparently she's not a regular offender and so was dealt with by way of a Police Caution. This stays on hre record for five years and means any further dishinesty gets more severley dealt with.

But we don't get our money and she gets to keep it.

Which seems rather unjust. The police however are encouraging us to make a small claim against her. So we've written to obtain her details from the Police database and then we are advised to pursue the claim.

Well it only seems fair to me.

Barclays update

I wrote to them as they operated the account in the name of Gail Taylor. It looks like this account was already under investigation and the inference is that it is being or will be shut down. They confirm there is no money in it. Not bloody surprising!

Barclays Fraud department said they were suprised the Police are not interested. So I have asked them to tell me who I go to. I'll update with their reply soon.

Fraudster details

His e-mail address is in name of Danny Cane but EBAY tell me his registered name is Danny Eastwood from York. However his phone number is from Dorset. His details, when I was bidding said he lived in Northolt, Middlesex.

The money went to Gail Taylor who banks with Barclays at their Tumbridge Wells branch.

Anyone recognise these people?

Ebay victims

The first time I ever used ebay was this year. I bid for some Take That tickets for my wife's birthday and won the bid at £200 in July 2007. The seller came under the name dannycane06@yahoo .com contacted me when I was away in France and insisted I send the money to a Barclays account in a woman's name, Gail Taylor. I wired the money and the confirmed receipt.

In November I emailed Danny three times abut when I would receive the tickets. No reply. The concert was not until 8th December but as of today, no tickets have arrived and no contact from the seller.

So I contact ebay. This gets really hysterical as they have a 60 day from date of transaction policy which basically means they do not get involved after this time has elapsed. I contacted the Police but they do not investigate ebbay fraud. I contacted my bank whose somewhat mysterious fraud tea are looking into the bank transaction.

But basically, I've been screwed and there is nothing I can do about it.

Except tell the world and hope you send me your ebay stories. The more we collect the more we can build a case vagainst ebay who cleafrly know what is going on and so are both guilty of negligence and failing in their basic duty of care. Remember they get rich out of our loss whatever.
